Mortgage Refinancing?

I am separated with my girlfriend with whom I bought a house exactly a year ago. We agreed that would take over pending mortgage on the new mortgage application with my co-signer. My questions are: "Why does my guarantor have to be in the title the house? "I'll have to go through a lawyer for my girlfriend removed from the title?

Hello, The Co-signer does not have ot be in the title, but remains responsible for the loan as im sure you are aware. As for his girlfriend, who is cooperating or willing to cooperate? If so, and answering other said, simply fill in a record settlement, which gives exclusive ownership of the property. If she is not willing to cooperate, then I'll have to consult with an attorney take care of it. The settlement is something that can be addressed by the title company during the process of refinancing, as a matter of done.
